⬆️ Appeal

A request to a higher court to review a decision.

Appeal

Trial outcomes are not always final. An appeal is a formal request that a higher court review a lower court’s decision for legal error.

Appeals focus on the record from the trial court—transcripts, exhibits, and filings—rather than new evidence. The appellant argues that the judge misapplied the law, admitted improper evidence, or committed another reversible mistake. The appellee defends the result. Appellate courts may affirm, reverse, remand, or modify the decision.

Strict deadlines and procedural rules govern notices of appeal, briefs, and oral argument. Most appeals do not include live testimony. A successful appeal can mean a new trial, entry of a different judgment, or clarification of the law for future cases. Unsuccessful appeals leave the original judgment intact.
