✍️ Affiant

A person who swears to an affidavit, a written statement made under oath.

Affiant

An affiant is the person who signs an affidavit. That is the whole definition, but the role carries weight. By signing, the affiant swears under oath that the statements in the document are true. If they are not, the affiant can face perjury charges.

Affidavits appear in many legal contexts. Police officers sign them to obtain search warrants. Witnesses sign them to provide testimony outside court. Parties in a lawsuit sign them to support motions. A notary public usually witnesses the signature and verifies the affiant's identity.

What an affiant must understand

An affidavit is not a casual document. It is evidence. Judges rely on affidavits to decide whether to issue warrants, grant summary judgment, or allow a case to proceed. An affiant who exaggerates or guesses can undermine an entire case. Precision matters more than volume. Say what you know, not what you assume.
