🔄 Risk Transfer

Shifting the financial consequences of risk to another party.

Risk Transfer

Contracts can move the financial weight of uncertainty from one party to another. Risk transfer is the shift of the potential financial consequences of a loss to another entity, most commonly through an insurance policy or a contractual indemnity clause.

Insurance is the classic mechanism: the policyholder pays a premium and the insurer assumes the defined risk. Hold-harmless agreements, waivers, and additional-insured endorsements also transfer or share risk among commercial parties. Effective transfer requires clear wording and a financially reliable party on the receiving end.

Incomplete or poorly drafted transfers leave gaps that surface only after a loss. Risk managers map contractual and insurance transfers together to ensure the intended party actually bears the exposure. When the transfer works as designed, the original party’s balance sheet is protected from the transferred loss.
