🤝 Joint Underwriting Association

An entity providing coverage when the market will not.

Joint Underwriting Association

When the voluntary market will not supply a needed coverage, states sometimes create a residual-market entity. A joint underwriting association, or JUA, is an organization established to provide insurance that is not readily available in the competitive market, with participating insurers sharing the results.

JUAs have been used for residual auto, medical malpractice, and other hard-to-place lines. The association issues policies, either directly or through servicing carriers, and assesses member insurers for deficits or distributes surplus. Rates and forms are often subject to regulatory approval.

The goal is availability rather than competition. Critics note that JUAs can accumulate large deficits if rates are inadequate. Successful operation requires credible pricing, competent claims handling, and a clear exit path if voluntary capacity returns. Member insurers ultimately bear the financial outcome.
